Terms Of Service
Cancellations & No Shows:
Upon your reservation, Kauai Island Weddings will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the Reservation Deposit is only partially refundable, even if the date is changed or the wedding cancelled for any reason; including acts of God, fire, strike and/or extreme weather. The Reservation Deposit is applied towards the contracted wedding/photography package. The client understands and agrees that the entire amount owed for the wedding and/or photography package is due on the Wedding Day.
Rescheduled Weddings. Kauai Island Weddings will do everything within their power to prevent a cancellation caused by inclement weather and will relocate the wedding to a beach where better weather is likely to be, or will reschedule the wedding itself to a later time, same day or another day to suit all parties. Should you, within the 60 day period leading up to your reserved wedding day, need to reschedule your wedding for whatever reason, it is considered the same as a cancellation and the full amount is due at that time. However we will credit that full amount towards your new wedding date, some time within the next 12 months, on a date and time to suit all parties. If the new wedding requires additional items or expense, only that amount will be due. There will be no additional penalty fee charged for this convenience.
Should you want to reschedule your wedding date more than 60 days prior to your wedding there is no penalty for doing so.
Wedding cancellations must be received in writing (by either mail or e-mail) at least 60 days prior to your wedding. A cancellation receipt must be confirmed by Kauai Island Weddings via a written acknowledgement. If you cancel your wedding less then 60 days prior to the event you are liable for the full amount of your original event reservation, which will be charged to your credit card on file. Cancellations received more then 60 days prior to the wedding date will receive a refund, less a $100 administrative fee. No Shows will be charged the full amount of the original event reservation. Monies for flowers, minister, photographers, musicians etc. that have been incurred, must be paid by the client, even if the client doesn't show at the agreed wedding time.
Wedding/Lodging cancellations (our customized Wedding & Lodging Packages that include a 7 night stay at the Kauai Country Inn) must be received in writing (by either mail or e-mail) at least 60 days prior to your wedding. A cancellation receipt must be confirmed by Kauai Island Weddings via a written acknowledgement. If you cancel your wedding/lodging arrangements less then 60 days prior to the event you are liable for the full amount of your original event & lodging reservation, which will be charged to your credit card on file. Cancellations received more then 60 days prior to the wedding date will receive a refund, less a $200 administrative fee. No Shows will be charged the full amount of both the wedding & lodging reservations. Monies for flowers, minister, photographers, musicians etc. that have been incurred, must be paid by the client, even if the client does not arrive at the Kauai Country Inn and/or doesn't show at the agreed wedding time.
Changes:
You can change your wedding location up until the day of your wedding - we are flexible and like to accommodate you - please see our location page for your choices. The DLNR of the State of Hawaii is requiring beach use permits for each wedding which must be applied for and obtained prior to your wedding day. The permits will be issued for a specific beach, and 1 alternate beach can be chosen. We will apply for and obtain these permits for you. The charge for these permits depending on the size of your group is between $75 to $200.
Bridal flowers, Limousine service, LIVE Web streaming and/or a wedding musician can be added until the day preceding your wedding; but if ordered originally must be cancelled at least 10 days prior to the event as we have contracts with our vendors that we are bound by. Many times the musician will require payment a month ahead of the venue.
Your responsibility:
The bride & groom agree to be at the wedding location at the specified time. The beach use permit which we apply for on the couple's behalf is issued for a specific 2 hour time frame which by State law, must not be exceeded. The bride and/or groom agree to set aside at least 30 minutes during the commencement of the wedding ceremony and a 60 minute time frame afterward for photographs. The 60 minutes following the ceremony includes group photographs. The size of the group attending the wedding will affect the final photography cost. If either the bride’s or groom’s late arrival (or any other reason outside of Kauai Island Weddings control) prevents this 90 minute window from occurring, Kauai Island Weddings shall not be held liable for failure to take desired photographs.
The clients will be responsible for (or have someone designated for this responsibility) identifying people/objects of whom/which specific photographs are desired. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for the photograph(s).
The photography schedule and selected methodology are designed to accomplish the goals and wishes of the clients in a manner enjoyed by all parties involved. The client and Kauai Island Weddings agree that positive cooperation and punctuality are therefore essential. Shooting commences at the scheduled time. Should the ceremony start late due to any reason whatsoever, Kauai Island Weddings will not be held liable for any photographs not taken. Kauai Island Weddings is limited by the guidelines of the ceremony, the weather, and/or the beach permit conditions. The client agrees to accept the technical results of their imposition on Kauai Island Weddings.
Photography:
Kauai Island Weddings will use their standard photographic formats (which are fine high resolution .jpg), and their standard photographic equipment (Nikon 12 megapixel cameras) unless otherwise discussed and agreed in writing before the wedding. If you have special requests you must discuss with Mike Hough before your wedding day. Some people request RAW images which we can shoot but will prevent us providing our usual 300-500 photos.
People's computer screens differ in color calibration as do individual human eyes, so our standards are based on the images you see throughout our website (www.kauaiislandweddings.com). Booking a wedding with Kauai Island Weddings assumes this standard is acceptable. No refunds on photo DVDs delivered.
Copyright of Photos:
The photographs, digital negatives or prints produced by Kauai Island Weddings are protected by Copyright Law. Upon final payment by the client, a shared copyright ownership of the resulting images will be transferred to the client under the following conditions: The digital negatives are the shared property of the client for personal use only, and for the purposes of the reproduction of photographs only. This shared copyright does not extend to other parties other than the client (bride & groom).
Although every possible care will be taken to produce photographs of all important and special events during the wedding, Kauai Island Weddings cannot place an unconditional guarantee on the above. Kauai Island Weddings will not be held responsible for any ruined photographs due to guest's (or any other) flashes; or any other ruined photographs due to any other cause in or outside of Kauai Island Weddings’s control.
Kauai Island Weddings will allow for limited professional image manipulation (if technically possible) on any images of Kauai Island Weddings choice, this includes: Rotating images if needed, red-eye reduction, lightening or darkening of images or minor color correction. It is understood that if a technicality prevents Kauai Island Weddings from performing requested image manipulation, or if a technicality prevents the final result to meeting the clients requirement, the client will reside with the fact that Kauai Island Weddings has performed to its best ability with regard to the specific task and that Kauai Island Weddings has no further responsibility towards said image manipulation. Additional retouching service are provided by Kauai Island Weddings at an additional fee: this includes opening of individual’s eyes, red eye removal, de-aging, removal of people and/or objects, insertion of missing people and/or objects, specific color correction, special effects, portrait glamorization etc. A specific quote will be provided upon details of what is required on which images.
Weather:
Kauai is a tropical island with beautiful weather all year round. Unless there is a mayor storm system coming across the islands dropping heavy rain, the weather on your wedding day should be beautiful with sunny skies. In case of bad weather, we usually give you the option of getting married on another day (providing that we have that day and your desired time available), or delaying the wedding for a few hours until the weather has passed. Sometimes the hotel where you are staying will allow you to get married under a covered area on their grounds if you ask them, however they may levy a charge for that service. Normally if it's raining in one area of the island it does not mean that it is raining everywhere. If you have your wedding scheduled on one of the East or North Shore beaches and we have to move the wedding to the South Shore for weather reasons you will incur the $50 Drive Out Fee mentioned below. Having said all that: Don't worry! Chances of great weather and a beautiful sunny day are overwhelmingly in your favor.
Group Coordination Fees:
Groups of over 10 people (incl. the wedding couple) take more time to arrange during the wedding, and for photography and/or videography after. Coordination fees are required for larger parties which include an additional half hour to one hour extra time of professional photography. Groups of 11-20 people will incur a coordination fee of $195, while groups of over 20 people will incur fee of $395 as extra staff is required and photography will take longer still. There is no coordination fee for groups of 10 people or less (incl. the wedding couple).
Site Fees:
Site fees to rented, private locations are non-refundable and payment is due at the time of booking. These site fees cover a time period of 2 hours for the wedding ceremony and photography after and do not include access to a nearby beach. Should you want to take extra photos on a nearby beach, a DLNR beach use permit is required in addition to the site fee - additional photography time and costs may apply.
Drive Out Fees & "Private Venue or Private Residence" Fees:
All Beach Weddings on Kauai's North & South Shores do incur a $50 drive out fee. This fee covers additional travel time for staff, and is waived for weddings on Kauai's East Shore. This fee increases to $100 for beach weddings past Hanalei Bay on the North Shore, and past Kalaheo on Kauai's South Shore.
There is an additional surcharge for any wedding at a private residence or any other private venue because from experience the time incurred is more than the 2 hour time period that is the basis for all our wedding cost calculations. On a beach the time is controlled by the DLNR State Beach Permit which is limited to 2 hours. Weddings at a private residence or other private venue will from experience take longer and therefore we have calculated an additional $100 fee for private venues or weddings at private residences on Kauai's East Side; on Kauai's North & South areas it is $150, and on Kauai's West Side it is $200. From experience these weddings always take longer and this fee covers additional wages for our staff.
These surcharges are in addition to any site fees charged by a particular location, be it a hotel, waterfall location, private gardens or a private residence.
There are NO drive out fees for weddings on Kauai's East Shore beaches.
Deposit:
A $200 deposit is required to secure your wedding date. A $300 deposit is required to secure your wedding/lodging package, which includes your 7 night stay at the Kauai Country Inn. The payment of this deposit constitutes your entering into a contractual agreement with Kauai Island Weddings (and the Kauai Country inn, in case of the combined wedding/lodging package), acknowledging and agreeing to the terms set forth above. This deposit in both cases goes towards your final bill total.
Kauai Island Weddings reserves the right to make changes to it's website, published rates, couple's wedding photo gallery structure, and terms of service without notice.
