Cancellations & No Shows:
Upon your reservation, Kauai Island Weddings will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the Reservation Deposit is only partially refundable, even if the date is changed or the wedding cancelled for any reason; including acts of God, fire, strike and/or extreme weather. The Reservation Deposit is applied towards the contracted wedding/photography package. The client understands and agrees that the entire amount owed for the wedding and/or photography package is due on the Wedding Day.
Wedding cancellations must be received in writing (by either mail or e-mail) at least 60 days prior to your wedding. A cancellation receipt must be confirmed by Kauai Island Weddings via a written acknowledgement. If you cancel your wedding less then 60 days prior to the event you are liable for the full amount of your original event reservation, which will be charged to your credit card on file. Cancellations received more then 60 days prior to the wedding date will receive a full refund, less a $75 administrative fee. No Shows will be charged the full amount of the original event reservation. Monies for flowers, minister, photographers, musicians etc. have been incurred and must be paid by the client, even if the client doesn't show at the agreed wedding time.
Changes:
You can change your wedding location up until the day of your wedding - we are flexible and like to accommodate you - please see our location page for your choices. The DLNR of the State of Hawaii is requiring beach use permits for each wedding which must be applied for and obtained prior to your wedding day. The permits will be issued for a specific beach, and 1 alternate beach can be chosen. We will apply for and obtain these permits for you. The charge for these permits depending on the size of your group is between $75 to $150.
Bridal flowers and/or a wedding musician can be added until the day of your wedding; but must be cancelled at least 14 days prior to the event as we have contracts with our florists & musicians that we are bound by. Many times the musician will require payment ahead of the venue.
Your responsibility:
The bride & groom agree to be at the wedding location at the specified time. The beach use permit which we apply for on the couple's behalf is issued for a specific 2 hour time frame which must not be exceeded. The bride and/or groom agree to set aside at least 30 minutes during the commencement of the wedding ceremony and a 60 minute time frame afterward for photographs. The 60 minutes following the ceremony includes group photographs. The size of the group attending the wedding will affect the final photography cost. If either the bride’s or groom’s late arrival (or any other reason outside of Kauai Island Weddings control) prevents this 90 minute window from occurring, Kauai Island Weddings shall not be held liable for failure to take desired photographs.
The clients will be responsible for (or have someone designated for this responsibility) identifying people/objects of whom/which specific photographs are desired. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for the photograph(s).
The photography schedule and selected methodology are designed to accomplish the goals and wishes of the clients in a manner enjoyed by all parties involved. The client and Kauai Island Weddings agree that positive cooperation and punctuality are therefore essential. Shooting commences at the scheduled time. Should the ceremony start late due to any reason whatsoever, Kauai Island Weddings will not be held liable for any photographs not taken. Kauai Island Weddings is limited by the guidelines of the ceremony, the weather, and/or the beach permit conditions. The client agrees to accept the technical results of their imposition on Kauai Island Weddings.
Copyright of Photos:
The photographs, digital negatives or prints produced by Kauai Island Weddings are protected by Copyright Law. Upon final payment by the client, shared copyright ownership of the resulting images will be transferred to the client under the following conditions: The digital negatives are the property of the client for personal use and for the purposes of the reproduction and distribution of photographs to friends and relatives only.
Although every possible care will be taken to produce photographs of all important and special events during the wedding, Kauai Island Weddings cannot place an unconditional guarantee on the above. Kauai Island Weddings will not be held responsible for any ruined photographs due to guests (or any other) flashes; or any other ruined photographs due to any other cause in or outside of Kauai Island Weddings’s control.
Kauai Island Weddings will allow for limited professional image manipulation (if technically possible) on any images of Kauai Island Weddings choice, this includes: Rotating images if needed, red-eye reduction, lightening or darkening of images or minor color correction. It is understood that if a technicality prevents Kauai Island Weddings from performing requested image manipulation, or if a technicality prevents the final result to meet the clients requirement, the client will reside with the fact that Kauai Island Weddings has performed to its best ability with regard to the specific task and that Kauai Island Weddings has no further responsibility towards said image manipulation. For additional retouching: this includes opening of individual’s eyes, red eye removal, de-aging, removal of people and/or objects, insertion of missing people and/or objects, color correction, special effects, portrait glamorization etc. a specific quote will be provided upon details of what is required on which images.
Group Surcharges:
Groups of over 10 people (incl. the wedding couple) take more time to arrange during the wedding, and for photography and/or videography after. Coordination fees are required for larger parties which include an additional half hour to one hour extra time of professional photography. Groups of 11-20 people will incur a surcharge of $195, while groups of over 20 people will incur a surcharge of $395 as extra staff is required and photography will take longer still. There is no surcharge for groups of 10 people or less (incl. the wedding couple).
Deposit:
A $200 deposit is required to secure your wedding date. The payment of this deposit constitutes your entering into a contractual agreement with Kauai Island Weddings acknowledging the terms set forth above. This deposit goes towards your final bill.
