terms of service

By submitting your reservation, you agree to be bound by the provisions of these Terms of Service. Kauai Island Weddings reserves the right to make changes to these Terms of Service without notice; any such changes will apply prospectively only. Unless Kauai Island Weddings agrees otherwise in writing, these Terms of Service constitute the entire agreement between you and Kauai Island Weddings concerning the subject matter covered here.

 

Deposits and Service Payments

To reserve your wedding date, a non-refundable deposit of $200 is required at the time of booking. This deposit confirms your reservation and covers the time and costs involved in securing staff, permits, and other arrangements for your special day. It will be applied toward your total wedding package price but is not refundable under any circumstances, even if you later cancel your event.

If you cancel 60 or more calendar days before your scheduled wedding date, you forfeit only the deposit amount.


If you cancel fewer than 60 days before your scheduled wedding date — or fail to provide written notice of cancellation — you remain responsible for payment of the full package price, which becomes immediately due.

Because our staff and beach permits are arranged well in advance, failure to send written notice of cancellation is treated as a cancellation within 60 days of your event.

As a small, family-run business, every reserved wedding date represents a real commitment of time and resources from our team. Your deposit helps us fairly cover these upfront costs and keeps your date secure while allowing us to give each couple the care and attention they deserve. Mahalo for understanding!

You are authorizing Kauai Island Weddings to charge your $200 reservation deposit (the Deposit) to book your wedding.
You shall also pay the entire amount owed for the wedding services you request in your reservation and in any subsequent communications with Kauai Island Weddings, including but not limited to add-ons to a wedding package (the Package Price), minus the Deposit, no later than 7 days prior to your event and at the latest by the day before your wedding date.

If you provide credit or debit card information to Kauai Island Weddings at any time, including when you submit your reservation, Kauai Island Weddings is entitled to charge the Deposit to such credit or debit card. Kauai Island Weddings is also entitled to charge to such credit or debit card any portion of the Package Price that remains unpaid on your wedding date. If you do not pay (or if Kauai Island Weddings is unable to collect) the Deposit or Package Price as specified above, Kauai Island Weddings may cancel your reservation without further notice.

 

Wedding Duration and Permits

The wedding ceremony’s duration will be between 10-20 minutes, as confirmed by email from Kauai Island Weddings. The duration may be subsequently changed with Kauai Island Weddings written approval. You understand that any applicable beach use permit that we obtain for your wedding is issued for a specific 2 hour time frame, which cannot be exceeded under Hawaii State law. Therefore, Kauai Island Weddings is not obligated to perform any services for you outside the time frame indicated on such beach use permit.

 

 

Wedding Industry Standard Late Fees

Kauai Island Weddings has scheduled staff and obtained a beach use permit for your event for a specific one or two hour time period, depending on your chosen package. Should you arrive more than 15 minutes late for your event, a late fee will apply. A late fee of $100 will be charged for every 30 minutes you are late from your originally booked event starting time. We may also be required to obtain a second beach use permit at your cost if we can not provide the services within the time frame of the originally purchased beach use permit we have secured for your event. 

Furniture on the Beaches

The State of Hawaii expressly prohibits the use of any kind of furniture and amplified music on all State beaches. All beaches in Hawaii are State beaches, there are no private beaches in the State of Hawaii, and Kauai Island Weddings can not and will not provide chairs, alters, or floral arbors on any beaches. The exception to this is when the couple have booked a private venue like a hotel property bordering the beach, or a botanical garden or waterfall location where such decorations are allowed.

 

Photography/Videography

If you have paid for photography or videography, Kauai Island Weddings’ photographers and/or videographer will only be available at the wedding location to take pictures from the wedding ceremony’s reserved start time until a maximum of 90 minutes after the wedding ceremony’s reserved end time. Kauai Island Weddings will not be liable for failing to take the agreed number of pictures, or filming time, if the failure is caused by the bride’s or groom’s late arrival, or any other reason outside of Kauai Island Weddings’ control.

 

You are responsible for identifying (or making someone available to identify) people/objects that you would like photographed or videotaped at your wedding. Kauai Island Weddings will not be responsible for not photographing or videotaping desired people/objects if you do not assist (or make someone available to assist) with identifying or gathering people/objects for the photographs or video.

 

Unless Kauai Island Weddings agrees otherwise in writing before the wedding, Kauai Island Weddings’ photographer will take pictures in high-resolution JPG format using Kauai Island Wedding’ standard photographic equipment. Unless Kauai Island Weddings agrees otherwise in writing before the wedding, Kauai Island Weddings’ videographer will take videos in HD digital format using Kauai Island Weddings’ standard videography equipment. Copyright laws protect the photographs, videos, digital negatives or prints produced by Kauai Island Weddings (the Photos/Videos). Once you have paid the Package Price in full, Kauai Island Weddings will give you a shared copyright ownership of the Photos/Videos under the following conditions: (i) your use of the Photos/Videos will be limited to only your personal use, and (ii) you may not assign, sell or otherwise transfer your shared copyright ownership in the Photos/Videos. Kauai Island Weddings reserves the right to use the Photos/Videos for its own advertising purposes; if you would rather we not do so, please let us know.

 

If applicable, based on the wedding package or add-ons you paid for, Kauai Island Weddings will perform color correction on certain photographs. This service is limited to any of the following: lightening, darkening or minor color correcting. You agree that if a technical issue prevents Kauai Island Weddings from color correcting an image you chose for that service, then Kauai Island Weddings will not be obligated to perform such service; instead, you may select an alternative image for such service.

 

Delivery times for photos, video and/or web stream are approximate and may vary slightly depending on number of photos taken or unfavorable weather conditions, which may require your photos or video to need additional work.

 

Kauai Island Weddings does not supply RAW footage of still images or video clips. Should there be a justified reason that a client must have RAW footage Kauai Island Weddings offers no guarantees of any kind because there has been no retouching or color correcting of those items and use of this footage/imagery is at your own risk. Kauai Island Weddings strongly recommends the use of final edited images and videos. Additional fees for the recalling of raw files and uploading them to a drop box for you to download will apply.

 

Drone videography is dependent on good weather conditions as the drone can not fly in high winds or rain. Should you have booked drone video with us (or it's part of your wedding package) and we are unable to fly the drone, we will offer to Reschedule to a later date or location where weather conditions are more favorable. Should you not want to reschedule the drone and rather Cancel, then we will refund $300 of the $595 drone package price back to your credit card, to cover the cost of our drone pilot who was at your event and willing to fly, but was unable due to circumstances out of his control. 

Disclaimer: Should you ask our staff to use your own equipment, any equipment (like a mobile phone, or your own camera to take of few pictures of you at the beach) or any other personal belongings of you or your guests, you do so at your own risk, and Kauai Island Weddings does not assume any responsibility for lost or damaged equipment. You hereby release Kauai Island Weddings and it's staff from any and all liability resulting from you having asked a staff member for a favor which resulted in equipment damage to your personal property.

 

 

Wedding Cancellations

All cancellations must be made by written notice sent to both hans@kauaiislandweddings.com and martina@kauaiislandweddings.com (the Cancellation Notice).

If you cancel 60 or more calendar days before your reserved wedding date, you will not be responsible for the remaining package balance; however, your $200 reservation deposit remains non-refundable.


If you cancel fewer than 60 days before your reserved wedding date — or do not provide written notice of cancellation — the full package price becomes due immediately.


No-shows on the wedding date are treated as cancellations under the same terms.

Please note that your wedding is considered officially cancelled only once you receive a written confirmation of cancellation from Kauai Island Weddings.

We strongly recommend that you purchase travel insurance to cover any potential cancellation costs.

Kauai Island Weddings will always make every reasonable effort to avoid cancelling a wedding due to inclement weather, acts of nature, or other circumstances beyond our control. If unforeseen events require postponement, we’ll gladly assist you in rescheduling your ceremony for another mutually agreeable date within 12 months of the original booking. Refunds are not available for cancellations or postponements beyond our control.

We understand that plans can change, and we’ll do our best to help make adjustments whenever possible. As a small, family-owned business, each date we reserve involves dedicated staff, permits, and preparation. Our cancellation policies ensure we can continue providing the personal care and attention that each couple deserves. Mahalo for your understanding and aloha spirit.

 

Wedding Credit

Other than Deposits and Rescheduling Fees, any payments you make toward the Package Price of a Wedding that you cancel or reschedule, are non-refundable and will be credited toward a new booking by you for a wedding to occur at a date that is mutually agreeable to you and Kauai Island Weddings and that is within 2 years of the originally reserved date. 

 

Rescheduling Your Wedding

1. General Rescheduling (More Than 72 Hours Before Your Ceremony)

You may request to reschedule your wedding date only by written notice (the “Rescheduling Notice”) sent to martina@kauaiislandweddings.com. Kauai Island Weddings will always do its best to accommodate your request; however, rescheduling your wedding to your preferred date may not always be possible due to existing bookings and staff availability. Therefore, Kauai Island Weddings reserves the right to accept or reject any Rescheduling Notice at its sole discretion.

If you send a Rescheduling Notice fewer than 60 calendar days before your reserved wedding date, and your request is accepted, you shall immediately pay Kauai Island Weddings 50% of the Package Price, which will be applied in full toward your rescheduled event (the “Rescheduling Fee”). Payment plans are available. Payment of the Rescheduling Fee is required to confirm your new wedding date.

All remaining payment obligations and deadlines will continue to be based on your original wedding date unless otherwise agreed to in writing by Kauai Island Weddings.

If you send a Rescheduling Notice 60 or more calendar days before your reserved wedding date, and your request is accepted, your first rescheduling request will not incur a Rescheduling Fee. Any subsequent rescheduling requests are subject to a $200 Rescheduling Fee, which will be charged immediately and applied toward your event invoice.

Rescheduling Fees are non-refundable. Kauai Island Weddings is entitled to charge any Rescheduling Fee to any credit or debit card you have previously provided. Should you later cancel your wedding after it has been rescheduled, no refund will be due or paid.

2. Last-Minute Rescheduling (Within 72 Hours of Your Ceremony)

A last-minute rescheduling request is defined as any request made within 72 hours (3 days) of your scheduled ceremony date and time.

We understand that unexpected circumstances can arise, and we will always do our best to accommodate last-minute rescheduling requests whenever possible. Because these requests often require significant scheduling changes, staff availability, vendor coordination, and, in some cases, the hiring of outside professionals, all last-minute rescheduling requests are subject to availability and cannot be guaranteed.

If your ceremony can be rescheduled using your originally scheduled wedding team, no additional fee will apply.

If accommodating your requested date or time requires changes to staffing, additional vendor coordination, or the hiring of outside professionals, a Last-Minute Accommodation Fee starting at $300 may apply. This fee helps offset the additional staffing, scheduling, and administrative costs associated with accommodating your request.

Kauai Island Weddings reserves the sole discretion to determine whether a Last-Minute Accommodation Fee applies and the amount of that fee based on the additional costs incurred.

3. Weather-Related Rescheduling on the Day of Your Wedding

If it appears that severe weather or heavy rain may significantly impact your ceremony (which is very unlikely and has occurred only a handful of times in over 5,000 weddings), we will gladly do our best to reschedule your wedding to another available date and time that fits our calendar.

If you wish to reschedule due to weather, you must call our office at 808-822-5381 at least 3 hours before your scheduled ceremony time.

If you notify us at least 3 hours before your ceremony, no rescheduling fee will apply.

If you notify us less than 3 hours before your scheduled ceremony, or if you arrive at the beach (or other agreed-upon venue) and decide not to proceed with your ceremony as scheduled, but instead request to reschedule to another date, time, or location, a Staff Rescheduling Fee starting at $50 per staff member assigned to your wedding will apply.

 

Examples:

  • Minister & Photographer: starting at $100

  • Minister, Photographer, Videographer, Musician & Onsite Coordinator: starting at $250

 

This fee is used to compensate staff members who have already traveled to and reserved time for your event.

Please note that last-minute rescheduling of seated weddings is generally not possible once venue setup has begun. If you have a seated wedding and believe weather may affect your ceremony, please contact our office at least 24 hours before your scheduled ceremony so we can discuss any available options with your venue.

If you cancel your wedding after it has been rescheduled, no refund will be due from or paid by Kauai Island Weddings, regardless of when the cancellation occurs.

Large Groups

Groups of over 10 people take more time to arrange during the wedding and for photography after. Therefore, all groups of 11 or more people (including the bride & groom) will incur an additional large group fee. This fee is reflected in the higher ticket price for larger groups for each of our offered wedding packages. Our package prices for groups of 15 people and over (including the bride & groom) also include an on-site wedding coordinator to make the wedding go more smoothly.

 

Changes to your Wedding Package & Details

You may change your wedding package up to 30 days prior to your wedding date, and any extras you have ordered up until 14 days prior to your wedding. Within 14 days of your wedding we can not accommodate cancellations of flowers, transportation, musicians, on-site coordinator/groomer, video or any other services that you may have added to your wedding package at a previous time. Wedding Package changes themselves can not be accommodated within 30 days of your wedding as we have committed to certain vendors who have specifically allocated their time for your event and your specific event time frame. However, additions to your wedding package may still be possible, please call or email us if you want to add something last minute. However, down grading to a less expensive package within 30 days, or cancellation of any booked services or flowers less than 14 days prior to your scheduled event can not be accommodated.

 

 

Site Fees

Certain wedding venues may require a site fee. In addition to the standard deposit, all site fees are to be paid in full upon booking, and are non-refundable. Site fees are subject to change without notice.

 

 

Wedding Credit

Disputes and Interpretation

These Terms of Services are governed exclusively by the law of the state of Hawaii and must be construed in accordance with the law of that state, without regard to conflict-of-laws principles.

 

 

As the exclusive means of initiating adversarial proceedings to resolve any dispute arising out of, or relating to, these Terms of Service, the party asserting the dispute may submit the dispute to binding arbitration before JAMS. The arbitration will be conducted in accordance with JAMS™ arbitration rules and expedited procedures, as they exist at the time the arbitration is filed. The arbitration must be scheduled to take place in Lihue, Kauai, Hawaii, before an attorney licensed to practice law in the state. The parties will initially share all of the fees and costs of the arbitration equally, but the prevailing party will be entitled to recover all its fees and costs of arbitration, as well as attorney’s fees. If a party files in court a dispute that is covered by this arbitration provision, the defending party is entitled to recover all fees and costs (including attorney’s fees) it incurs in connection with the court proceedings, including compelling the dispute to arbitration, regardless of whether the defending party prevails in court or arbitration. The arbitrator shall have no power to alter or amend these Terms of Service or to award any relief inconsistent with the provisions herein or unavailable in a Hawaii court of law. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

 

You shall maintain the confidential nature of the arbitration and the arbitral award, except (i) as may be necessary to prepare for or conduct the arbitration hearing on the merits, (ii) as may be necessary in connection with a judicial challenge to an award or its enforcement, or (iii) as otherwise required by law or judicial decision.
